Terms of Service

1. About these Terms
These Terms govern your access to and use of the GetRenting website, owner workspace, workflows and related services (the Service). In these Terms, GetRenting, we, us and our mean Get Renting Pty Ltd (ABN 35 690 434 603), the operator of the Service, and you means the account holder.
By creating an account, accepting these Terms or using the Service, you agree to these Terms and our Privacy Policy. If you use the Service for another person or entity, you confirm that you have authority to bind them.
2. What GetRenting does
The Service provides software, records and guided workflows to help NSW rental owners self-manage their properties. Features may include property and tenancy records, reminders, document extraction, draft communications, rent matching, maintenance workflows and owner-approved notices.
GetRenting does not act as your agent, property manager, representative, lawyer, accountant, financial adviser or real estate adviser. We do not independently select tenants, negotiate or enter agreements, set rent, approve repairs, exercise a landlord's powers, issue instructions on your behalf, or make legal or commercial decisions for you.
Where the Service prepares a draft, inserts information, schedules a reminder or technically sends an item you have selected and authorised, you remain responsible for the instruction, decision, content, recipient and timing.
3. Your account
You must be at least 18 years old, provide accurate information and be authorised to manage every property and tenancy added to your account. You are responsible for keeping your login and authentication methods secure, restricting account access and promptly telling us about suspected unauthorised use.
You must not share an individual login, bypass security controls, probe or interfere with the Service, upload malicious content, use the Service unlawfully, or access another person's data without authority.
4. Your responsibilities as landlord
You remain responsible for complying with the residential tenancy agreement and all applicable laws, including requirements concerning notices, rent, bonds, repairs, safety, privacy, records and time limits. You must review information produced by the Service before relying on it and correct incomplete or inaccurate records.
Templates, calculations, checklists and workflow suggestions are general software outputs, not legal advice and not a guarantee of compliance or outcome. Circumstances differ. You should obtain professional advice when a matter is uncertain, disputed, urgent or outside the ordinary workflow.
Schedules, reminders and late fees
You are responsible for setting up and maintaining your bill and reminder schedules, checking dates and amounts against the original bills or notices, and keeping your contact details and notification preferences current.
Reminders assist you with these tasks; they do not replace your own checks or extend a due date. You must check upcoming obligations and pay bills on time even if a reminder is not configured, is delayed or is not delivered, including because of a technical issue.
You remain responsible to the relevant biller or authority for amounts due, including any applicable late fees, interest or penalties. This does not exclude any right you may have to a remedy from GetRenting for a failure of the Service, including under the Australian Consumer Law.
5. Tenant and property information
You must only give us personal information that you are entitled to collect, use and disclose for managing the relevant property or tenancy. You are responsible for the accuracy of that information and for communications sent to tenants, former tenants, agents, trades and other recipients through your account.

6. Rent and bond money
Rent is paid directly by the tenant to the owner's nominated account. GetRenting does not receive, hold, control or deduct money from rent. GetRenting also does not receive or hold rental bonds. You remain responsible for Rental Bonds Online and any other required trust, bond or payment process.
Rent records are based on the payments you confirm. You must check that a payment has reached your bank account before recording it as received. You must resolve discrepancies and make any decision about arrears or follow-up action.
7. Subscription charges
There are no subscription charges during the current initial phase. No payment authority is required, and using GetRenting or recording rent during this phase does not accrue subscription fees for later collection.
Before introducing a paid subscription, we will explain the price, billing frequency and payment terms. You must choose to subscribe and authorise payment before billing starts. Charges will not be applied retrospectively to this initial phase.
Email support is described in section 15. Agent services, in-person inspections, trades and advertising are not included.
8. Optional services and third-party providers
Agent services are not currently available. If we introduce them, we will publish the provider, scope, prices and applicable booking terms before you can engage a service.
Optional OpenFeed connection
When connecting OpenFeed, you authorise GetRenting to receive and use the account data you choose for rent matching, as described in our Privacy Policy. The disclosed copy is handled under the Privacy Act, outside the CDR Privacy Safeguards.
You must provide accurate information, use the connection lawfully and report unauthorised access promptly. Illegal or harmful use, including fraud, money laundering, extortion, unlawful gambling or trafficking in unlawful goods, is prohibited.
Subject to rights that cannot lawfully be excluded, GetRenting and Biza do not guarantee uninterrupted access or complete, accurate data, or suitability for every purpose. Check the underlying records before relying on a match. Your non-excludable rights under the Australian Consumer Law and Privacy Act remain.
For these OpenFeed provisions, Biza Pty Ltd is a third-party beneficiary entitled to enforce them. GetRenting enters these provisions on its own behalf and as Biza’s limited agent for obtaining acceptance.
Technology providers
The Service may connect to providers for identity, banking data, payments, email, hosting or document processing. Those services may have their own terms and availability. We are responsible for our integration and vendor choices, but not for an outage or decision made solely by a third-party provider, bank or government service.
9. Availability and changes
We use reasonable care to keep the Service available and secure, but do not promise uninterrupted or error-free operation. We may maintain, change or discontinue a feature where reasonably necessary. We will give reasonable notice where a material change adversely affects an active paid plan, unless urgent security, legal or provider action prevents advance notice.
10. Cancellation and records
You may stop using the Service and cancel a paid plan through the available account process. We will provide a reasonable way to export core property and tenancy records before account closure, subject to security checks, applicable law and any stated retention period.
We may suspend access where reasonably necessary to address non-payment, unlawful use, a material breach or a security risk. Where practical, we will tell you the reason and give you an opportunity to fix the issue.
11. Intellectual property
We own the Service, its software, design and original materials. You retain ownership of information and documents you provide. You give us a limited licence to process that material only as needed to provide, secure and improve the Service and meet our legal obligations.
12. Consumer rights and liability
Nothing in these Terms excludes, restricts or modifies a guarantee, right or remedy that cannot lawfully be excluded, including rights under the Australian Consumer Law.
To the extent permitted by law, GetRenting is not liable for indirect or consequential loss, or for loss caused by information or instructions supplied by you, your failure to review an output, or a decision that remains your responsibility as landlord. Any permitted limitation is subject to applicable consumer guarantees and will be applied only to the extent that it is fair and lawful.
13. Disputes and governing law
Please contact us first so we can try to resolve a concern promptly. These Terms are governed by the laws of New South Wales, Australia, and the courts and tribunals of New South Wales have jurisdiction.
14. Changes to these Terms
We may update these Terms. We will publish the new effective date and give reasonable notice of material changes. We may ask you to accept a new version before continuing to use materially changed or paid features.
